Terms for hospitals

Version 1 · 28 October 2026 · accepted when a hospital, clinic or diagnostic centre registers

These terms are the agreement between the company that operates Hospita ("Hospita", "we") and the hospital, clinic or diagnostic centre that registers on Hospita ("the hospital", "you"). The person who registers confirms that they may accept them for the hospital.

In short. You subscribe to a plan for the whole platform; the plan sets how many doctors, patients and AI chats are included. On each visit or test that a patient books and pays for through Hospita's assistant, Hospita keeps a fee of 4 to 5% of it; bookings your front desk makes carry no fee. Your patients' records are yours: you decide, we process them for you under the Data processing terms. Your doctors decide on care; Hospita's AI only suggests. Fees are for the period paid and are not refunded.

1. The service

  • Hospita provides software for running a hospital: online booking and the hospital's own assistant, the OPD and front desk, doctors' diaries, fees and payments, patient records, prescriptions, test requests and results, video visits, messages to patients, figures and the audit trail, a website, and AI suggestions for doctors, together "the service". What each plan includes is shown on the Pricing page and in your account.
  • We may improve and change the service. We will not take away a main part of a plan you have paid for during the period paid, unless the law or the security of the service requires it; if we must, we tell you in advance and you may end the plan and receive back the unused part of what you paid for it.

2. Your account and your people

  • The person who registers becomes the hospital's administrator. You keep your sign-ins secret, give each person their own account and only the access their work needs, and remove access when someone leaves. You answer for what is done with your accounts.
  • A doctor joins your hospital only with the code Hospita sends to that doctor's own email, which the doctor gives you. A doctor may work at several hospitals on Hospita with one account; each hospital sets its own fee and hours, and sees only its own patients.
  • You give true information about the hospital, its doctors and their registrations, and keep it up to date.

3. Your plan, its limits and its fees

  • The fees, the limits (doctors, patients, AI chats) and the price of an extra doctor are those of your plan as shown when you order it. Fees are paid in advance for each month or year. Taxes are added where the law requires.
  • When a limit is reached, Hospita refuses what goes beyond it (for example, one more doctor) until you move to a larger plan or the period renews. A larger plan applies at once; a smaller one from the next renewal.
  • Fees are for the right to use the service and its cloud for the period paid, and are not refunded, in whole or in part, except where these terms or the law say otherwise. If a payment fails or is late, we tell you and may limit the service to reading your records until it is paid.
  • We may change a plan's fees from your next renewal, telling you at least 30 days before.

4. The fee on bookings made through Hospita

  • When a patient books and pays for a visit or a test through Hospita's assistant, your website's chat or the Hospita app, Hospita keeps a fee of the percentage set in your plan, between 4% and 5% of the amount paid. A visit or test your front desk books, a walk-in, and a test your own doctors ask your own lab to do carry no fee.
  • The payment is made through the payment gateway for your country to your own account with that gateway, and the gateway pays Hospita's fee to Hospita as the payment is made. The gateway's own charges are between you and the gateway.
  • Hospita never pays anything to a hospital or a doctor for sending a patient to a diagnostic centre or another doctor, and no fee depends on a referral.

5. Patients' payments and refunds

  • You set your fees. The patient pays you, and a refund is paid back the way the patient paid, as the Patient terms say; you give effect to them. When a patient cancels in time, the refund is the fee less Hospita's fee and the gateway's fee on that payment, both shown to the patient before paying. When you cancel a visit, the patient is refunded in full, and you bear what the gateway does not return.
  • You answer to your patients for your fees, your invoices and receipts, and the tax on them.

6. Care is yours; the AI only suggests

  • Hospita is software. It does not practise medicine, give medical advice or take part in any decision about a patient's care. Your doctors and staff decide, and you answer for the care you give, the prescriptions you write, the tests you order and the results you release.
  • Hospita's AI suggests and summarises: possible diagnoses, tests to consider, prescription checks, lab report readings, visit summaries, a brief before each visit. A suggestion may be incomplete or wrong. It is shown to a doctor to read and decide on, and must never be used without the doctor's own judgement. Hospita's booking assistant finds a doctor from what a patient says; it does not diagnose, and tells a patient who describes an emergency to call emergency services.
  • A diagnostic centre on Hospita answers for its tests, its results and its reports. "Hospita Verified" means that Hospita has checked the registrations and licences the centre gave it, while they are in date; it is not an authorisation, an approval or a guarantee of quality.

7. Your duties under the law

  • You hold the registrations and licences your work needs, and so do your doctors.
  • You use Hospita lawfully: you have a lawful basis for the patient data you keep in it, you give your patients the information the law requires about your use of it, and you keep medical records for as long as the law requires.
  • You do not use Hospita to send messages patients did not ask for, to advertise in breach of the rules on advertising by doctors and hospitals (in India, the National Medical Commission's), or to break any law.
  • You do not try to reach data that is not yours, test the service's security without our written agreement, overload it, or copy or resell it.

8. Your patients' data

  • The records you keep in Hospita about your patients are yours. You are their controller; Hospita processes them for you, only on your instructions, under the Data processing terms, which are part of these terms. Where HIPAA applies, those terms are also the business associate agreement between us.
  • A patient's Hospita person (the details they give once) and their own app belong to the patient, and are kept by Hospita for them under the Privacy notice. Records pass from your hospital to another only when the patient allows it.

9. Your website on Hospita

If you publish a website from Hospita's templates, the Website terms for hospitals apply to it and are part of these terms: you publish it and answer for its content.

10. Availability and support

  • We take reasonable care to keep the service available and secure, and to fix faults promptly. Planned maintenance is done at quiet hours where we can, and told in advance where it is long. We do not promise that the service will never be interrupted or free of errors.
  • Support is given by email and in the service, on working days.

11. What belongs to whom

  • The service, its software, its templates, its words and its look belong to Hospita or its licensors. You may use them for your hospital while your plan is active.
  • Your data, your words and your pictures stay yours. Ideas you give us to improve Hospita may be used freely.

12. Confidentiality

Each of us keeps the other's confidential information confidential, uses it only for these terms, and shares it only with people who need it and are bound to keep it confidential, or when the law requires.

13. Ending

  • You may end your plan at any time; it runs to the end of the period paid and is not renewed.
  • We may end or suspend the service at once if you seriously break these terms, misuse the service or put patients or other hospitals at risk, or if the law or a court requires it. Otherwise we may end it with 30 days' notice, and refund the unused part of the period paid.
  • When the service ends, you may export your records for 30 days. After that they are deleted as the Data processing terms say, apart from what the law requires us to keep.

14. Liability

  • The service is provided as described in these terms. Apart from what these terms promise, and as far as the law allows, Hospita gives no other promise, express or implied, about the service.
  • Neither of us is liable to the other for loss of profit, revenue, goodwill or data that could have been restored from your own copies, or for indirect or consequential loss.
  • Each party's total liability under these terms in any 12 months is limited to the fees you paid Hospita in those 12 months.
  • Hospita is not liable for the care given by you, your doctors or a diagnostic centre, for a decision taken on an AI suggestion, or for the content of your website. You will make good any claim against Hospita caused by your care, your content or your breach of these terms or of the law.
  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law.

15. Law and disputes

These terms are governed by the law of the country where the company that operates Hospita is registered, and its courts decide disputes, without taking away the protection of any law of your country that cannot be set aside by agreement. Before going to court, each of us will first try in good faith, for 30 days, to settle a dispute by talking.

16. Changes to these terms

We may change these terms. We tell administrators at least 30 days before a change applies, unless the law requires it sooner; continuing to use the service after that means accepting the change. Hospita records which version each hospital accepted and when. The version and its date are at the top of this page.

17. General

  • These terms, your plan, the Data processing terms and the Website terms for hospitals are the whole agreement between us about the service. If they disagree, the Data processing terms decide on personal data, and these terms on everything else.
  • Notices to you go to your administrator's email; notices to us go to the address on the Contact page.
  • Neither of us is liable for a delay caused by events beyond reasonable control. You may not transfer these terms without our agreement; we may transfer them to a company that takes over the service, and tell you.
  • If a part of these terms cannot be enforced, the rest still applies.
